Bill: Hey, it’s Bill with MDWVHomebuyer.com Hey, I thought it would be of value to make a quick video about the evictions process here in Berkeley County, West Virginia. I am right here in front of the magistrate court and this is where it all happens. I get a lot of questions from landlords who come to our meetup group here in Berkeley County. It’s the Berkeley County Real Estate Investor meetup group. They reach out to me and they say, hey, I’ve got a tenant. They’re causing me some problems. I don’t know what to do to get started here. So I thought I would do a quick video about Evictions in Martinsburg. To just outlined some of the things that that landlords can do to move that process along when they’re having tenant problems.

So it’s pretty simple. You just come down here to the magistrate court and just ask a couple questions, get yourself in the right office, and you’re probably first going to, in most cases, file a failure to pay. Then if you want to move forward with the eviction process, you’ll fill out some paperwork. And then you’ll have the sheriff give your tenants a summons. And then about 10 days later you’re going to have a court date. In most cases, the magistrate will look at what documentation you’ve got and talk to the tenants and make a decision. Based on the Magistrates decision, you and the tenant can make a decision at that point or you can move forward with the eviction process if he’s ruled in your favor.

If they don’t show up, then you’re going to come back in and have the sheriff go back out and give him another 10 day notice. At that point, they’re MIA. Then they’ve got to put a notice in the newspaper and you’ve got to wait a little bit longer, usually a 30 day period. And at that point, what they’ll do is, after that process of waiting all those days, then they’ll show up and forcibly remove the tenant from the property or from your location and put their property out.

So not a good situation for the tenant by any means. Not a good situation for the landlord, but that’s kind of very quickly how the process works. Don’t be intimidated by the process.
